DEPORTATION (REMOVAL):
Deportation (removal) is a civil proceeding in which the federal government orders a non-U.S. citizen, or “alien,” to be removed (deported) from the United States for violating immigration or criminal laws. The removal proceeding is commenced by the Department of Homeland Security (DHS) which has the discretion to “serve” an alien with a charging document called “Notice to Appear” (NTA) containing allegations of immigration law violations. When an Immigration Judge hears the case there are two possible findings:
- the alien is removable from the United States, or
- the alien is eligible for a form of relief from removal
If eligible, individuals in removal proceedings can apply for various immigration benefits. The most frequently requested forms of relief that are available to an alien who has been found to be removable are:
